New York Court Strips Giuliani of His Law License Over False” Statements About the 2020 Election
The surprise ruling raises questions about the First Amendment.
A New York court has decided to strip former New York City Mayor Rudy Giuliani of his law license.
“[W]e conclude that there is uncontroverted evidence that respondent communicated demonstrably false and misleading statements to courts, lawmakers and the public at large in his capacity as lawyer for former President Donald J. Trump and the Trump campaign in connection with Trump’s failed effort at reelection in 2020,” the court ruled.
Giuliani had argued that “even if his statements were false or misleading, he did not make the statements knowing they were false when he made them,” the court said.
He said the First Amendment protects his right to make statements.
Many of the statements appear to come down to semantic or math errors, such as the number of Pennsylvania mail-in ballots or a dispute about the legal issue at play in a particular court case. In one case, the state asserted the right to strip Giuliani of a law license for what he said in another state.
Curiously, while the state had time to prosecute Giuliani over what largely boils down to bad information he had to a difference of interpretation, the same state won’t be prosecuting criminal thugs who looted businesses.
The state of New York is also in the midst of a witchhunt against former President Donald Trump over a matter of a loan application and the worth of his properties.
Meanwhile, Governor Cuomo has yet to be charged for putting COVID-infected patients in nursing homes, sexually harassing women, a questionable book deal and using taxpayer resources to benefit his family.
